Davin Healthcare Software Solutions, Inc. and Davin Healthcare Workforce Solutions, Inc. (collectively referred to as “Davin Healthcare,” “we,” “us” or “our) have created this Privacy Policy in order to disclose how Davin Healthcare collects, uses, and discloses personal information and other data collected about you in connection with your use of the Nurses Go mobile application and/or our website. This Privacy Policy is effective as of October 21, 2022. 

We collect certain information through our mobile application, Nurses Go (hereinafter the “Mobile App”), and through our associated website, located at https://davin.davinhealthcare.com (hereinafter the “Website”). This Privacy Policy sets forth our policies concerning the collection and handling of any information that identifies an individual user or that could be used to contact or locate him or her (hereinafter “personal information,” “personally identifiable information,” or “PII”). Please read this Privacy Policy carefully before submitting information over the internet. This Privacy Policy constitutes a binding legal contract between Davin Healthcare and you. 

This Privacy Policy applies to individuals who are using our Mobile App or Website to apply for temporary healthcare staffing positions offered at hospitals and healthcare organizations where we provide temporary staffing managed services as well as to existing Davin Healthcare temporary employees who are using the Mobile App or Website to upload their credentialing documents in connection with their temporary assignments. It does not apply to any third-party site or service. Some third-party websites or other such resources may be linked to our Website or Mobile App. These third-party sites have their own privacy policies and terms of use, which we do not control. We do not monitor, endorse, guarantee or assume any responsibility for these third-party websites or any information you may undertake, receive or exchange with such third-party sites. 

By accessing our Mobile App or Website, you acknowledge that you understand our Privacy Policy and consent to the information collection and use policies contained herein. If you do not consent to the information collection and use practices described below, please exit our Mobile App or Website. 

Information We Collect 

We collect personal information from users who apply for temporary healthcare staffing positions with Davin Healthcare including first name, last name, email address, street address, telephone number, and other personal information. We also collect information regarding your areas of specialization and your geographic preferences for temporary contract or per diem assignments. Additionally, we collect information and documentation required in order for you to qualify for the temporary position(s) for which you have applied including information about the degree(s), licenses, and certifications you hold, information about your employment history, and other credentialing records required to comply with the standards established by the Joint Commission applicable to our business and the facility-specific standards established by hospitals and healthcare organizations offering temporary assignments. Additionally, we collect personal information and credentialing documents from existing Davin Healthcare temporary employees to maintain their continuing eligibility for temporary assignments. For example, we collect records pertaining to renewals of required CPR certifications. 

We use cookies to collect anonymous visit information for statistical purposes, to diagnose problems with the Mobile App and Website, and to improve the quality of our services. In order to compile this information, we may collect and store your IP address, your operating system version, your browser version, and the areas of the Mobile App or Website that you access. We collect IP addresses and associate them with established user accounts for analytical and security purposes. 

We do not collect any financial information from users who request information about open positions. No part of this Website is designed or directed to Children. To be eligible to apply for a temporary position, you must be at least eighteen (18) years of age. Children may not use our Mobile App or Website. Consistent with the Children’s Online Privacy Protection Act, we do not ask for or knowingly collect information from children. 

How We Use Your Information 

We use the personal information you supply in order to create your user account, to communicate with you concerning open positions for which you may be qualified, to submit your candidate profile and required credentials to hospitals and healthcare organizations where you have applied for contract or per diem position through Davin Healthcare, and to communicate with you regarding your assignment(s). For example, we use your e-mail address in order to notify you of open assignments at healthcare facilities and to notify you of a healthcare facility’s acceptance of your candidate profile. 

We may send certain messages, including electronic newsletters, notification of account statuses and marketing communications, on a periodic basis. These communications are sent via electronic mail outside of the Mobile App and Website. If you wish to be removed from such messages, you may request to discontinue future ones by opting out following the instructions in the email message or by contacting support. 

After you apply for an open assignment and with your express written authorization, we share information collected as part of the credentialing process with a third-party provider of background checks. We also share information collected during the application and credentialing process with supervisory staff at health care facilities who are responsible for making and/or providing input with respect to, hiring decisions concerning temporary staff. If you accept a temporary assignment at a hospital as an assigned employee of Davin Healthcare, authorized personnel within the facility will have access to your credentials as needed to verify your eligibility and qualifications and to satisfy regulatory and certification requirements. 

We may disclose PII to accountants, our insurance carriers and to federal and/or state regulatory agencies where such information is needed for tax or audit reasons, for underwriting purposes, or to fulfill a regulatory requirement. For example, if you are injured on the job and file a workers’ compensation claim, we will share PII with our workers’ compensation insurance carrier. 

We may also disclose PII to attorneys and law enforcement agencies in connection with litigation and to address acceptable use policy violations, contract violations or illegal behavior. We disclose any information demanded in a court order or otherwise required by law or to prevent imminent harm to persons or property. Finally, we may share PII in connection with a major corporate 

transaction, such as a merger or sale of our company. We may share statistics derived from the information you supply, such as percentage of BSN-educated nurses comprising our workforce, however we do not include PII in such statistics. Except as set forth in this Privacy Policy, we do not share PII with third parties. We will not engage in a “sale” of your personal information. 

Measures To Protect Your Information 

In coordination with our hosting partner, we employ the following data security tools in order to protect your personal information: use of 256-bit encryption security certificate to transmit your personal information between your browser and the server that hosts our Website; use of two-factor authentication to limit unauthorized access to our system; physical controls, including automatically locking doors and 24/7 surveillance of the facility where our server is located; and suspension of user credentials after 5 unsuccessful login attempts to our system. Ultimately, even with these measures, we cannot guarantee the security of your PII. 

NO DATA TRANSMISSION OVER THE INTERNET CAN BE GUARANTEED TO BE 100% SECURE, AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ANY LIABILITY IF A THIRD-PARTY ILLEGALLY OBTAINS YOUR PERSONAL INFORMATION. BY USING OUR MOBILE APP OR WEBSITE TO CREATE A USER ACCOUNT AND APPLY FOR AN OPEN CONTRACT OR PER DIEM POSITION, YOU ACKNOWLEDGE AND AGREE THAT WE MAKE NO SUCH GUARANTEE. 

In order to protect your privacy, we encourage you to: 

  • Never share your user name or password; 
  • Always sign out when you are finished using the Website; 
  • Use only secure web browsers; 
  • Employ up-to-date antivirus and antimalware protection on your computer; 
  • Ensure that your operating system is up-to-date; 
  • Use a strong password; 
  • Change your password often; and 
  • Notify us immediately if your credentials have been compromised in any way. 

Accessing and Correcting Your PII 

You can access and change any personally identifying information you supply by contacting our Credentialing Department at (877) 871-1611 Option #5 for instructions. 

International Transfer of your Personal Information 

Our Mobile App and Website are hosted and operated in the United States and are subject to United States law. Any personal information that we collect from you is stored and processed in the United States. If you are accessing the Mobile App or Website from outside the United States, you consent to the transfer of your personal information to the United States. Please be advised that United States law may not offer the same privacy protections as the law in your jurisdiction. 

Additional Privacy Rights 

If you live in a jurisdiction that provides for additional rights regarding your personal information, such as the right to access or delete your personal information, and you wish to exercise those rights, please contact us using the contact information below. 

California Privacy Rights 

The California Consumer Privacy Act (CCPA), as amended, provides certain privacy rights to some California residents concerning their personal information, including the right to access and delete your personal information as well as opt-out of the sale of personal information if such information is or can be sold. 

Davin Healthcare does not presently conduct business in the State of California. 

Further, were Davin Healthcare to conduct business in the State of California, the personal information collected, used and/or disclosed by Davin Healthcare typically relates to individuals that are currently excluded in full or in large part from the CCPA, such as Davin Healthcare employees and job applicants. 

Nonetheless, Davin Healthcare will not engage in a sale of your personal information. If you provide your personal information to Davin Healthcare and wish to exercise rights granted under the CCPA, please contact us via the contact information below. 

Amendments 

Davin Healthcare may amend this policy at any time by posting an updated version of the Privacy Policy (with its effective date) in the Mobile App and on the Website. Before Davin Healthcare may use personal information collected through the Mobile App or Website site in a manner materially different from that stated at the time of collection, Davin Healthcare will notify users via email and/or by posting a notice in the Mobile App and on the Website for thirty (30) days prior to such use. This Privacy Policy may not be otherwise amended except in a writing that specifically refers to this Privacy Policy and is signed by both parties. 

Data Retention and Deletion

Davin Healthcare retains personal information only as long as necessary for the purposes outlined in this Privacy Policy or as required by applicable law. This may include retention for compliance, dispute resolution, and enforcement of our agreements.

Data Deletion Requests:
Users may request the deletion of their personal information by contacting the Davin Healthcare Support Team. Upon verifying the request, Davin Healthcare will permanently delete or anonymize the user’s personal information unless we are required to retain it for legal or legitimate business purposes.

Your Acceptance of the Terms 

By establishing and accessing your user account, you acknowledge that you have read, understand and agree to be bound by this Privacy Policy. If you do not agree with this Privacy Policy, do not create a user account and please exit the Mobile App or Website. Your continued use of our Website following a change to our Privacy Policy will signify your acceptance of the changes to such Privacy Policy.
